Terms of Service
Last updated: 2026-10-15
Who we are
These terms apply to plumbing, heating and air-conditioning installation services provided in Essex by:
- MARIE AIR FIXING LTD (trading as MARIE AIR FIXING)
- 25 Partridge Green Basildon, Essex SS13 3EF
- Email: admin@marieairfixing.co.uk
- Company number: 17470974
We provide on-site installation services to consumers and businesses. These terms apply together with any written quote, survey report or other written agreement we give you.
Quotes and site surveys
We may provide a quote following your enquiry or a site survey. A site survey may be needed to assess the proposed work, access, existing services, equipment requirements and any installation risks.
Unless we state otherwise, a quote is based on the information available when it is prepared and is subject to:
- The accuracy of the information you provide;
- The condition and suitability of existing services, structures and equipment;
- Suitable access to the property;
- Required permissions and approvals being available; and
- No unforeseen work being identified before or during installation.
A quote will state its period of validity where applicable. A quote is not a binding booking until we have accepted your order and confirmed the booking in writing.
If additional work becomes necessary, we will explain the reason and any additional price before carrying it out wherever reasonably practicable. We will not charge for additional work that you have not agreed to, except where the work is necessary to prevent immediate damage or risk and it is not reasonably practicable to obtain your agreement first.
How a booking is formed
You may accept a quote by email or another method we agree. A booking is formed when we confirm your acceptance in writing, issue a booking confirmation or otherwise agree a date to carry out the work.
We may decline or cancel a proposed booking where the work is not suitable, the site cannot reasonably be accessed, required permissions are unavailable, or circumstances make the work unsafe or impracticable. If we cancel before work begins, we will refund any payment made for work that we have not provided.
Prices and payment
Prices are in pounds sterling (GBP). Unless the quote says otherwise, the price covers only the work, materials, equipment and services expressly described in the quote.
The price may not include work or costs outside the agreed scope, including unforeseen remedial work, additional materials, building work, permissions, specialist access arrangements or making good areas that were not included in the quote.
Any deposit, balance and payment dates will be stated in the quote, booking confirmation or invoice. You must pay invoices by the stated due date. We may delay or suspend work where a required deposit or other payment has not been received.
For consumers, prices and charges will be presented in accordance with applicable consumer law. We will not impose additional charges unless they have been agreed with you or are otherwise permitted by law.
Your responsibilities
You must:
- Provide accurate information about the property, existing systems and the proposed work;
- Provide safe and reasonable access to the property and work areas at the agreed times;
- Ensure that an adult is available where reasonably required for access or decisions;
- Provide suitable access to electricity, water and other services reasonably needed for the work;
- Tell us about hazards, restrictions, asbestos or suspected asbestos, fragile areas, parking restrictions and other relevant site conditions;
- Obtain any planning permission, building regulation approval, landlord consent, freeholder consent, leaseholder consent or other permission that is your responsibility; and
- Ensure that the property is suitable for the work and that any required preparatory work has been completed.
You must not ask us to carry out work that would breach a law, regulation, permission or safety requirement. You are responsible for losses or additional costs caused by inaccurate information, unavailable access, unsuitable conditions or permissions that have not been obtained.
Scheduling, access and delays
We will agree an intended installation date or timescale with you. Dates and times are estimates unless we expressly agree otherwise in writing.
We may need to rearrange work because of severe weather, illness, vehicle or equipment problems, supplier delays, unavailable materials, unsafe conditions, access problems, emergency work or other circumstances outside our reasonable control. We will contact you as soon as reasonably practicable and offer a rearranged date.
If we are responsible for a delay, we will work with you to agree a reasonable alternative date. Nothing in these terms limits your statutory rights where a service is not provided within an agreed time or within a reasonable time.
Consumer cancellation rights
If you are a consumer and the contract is made at a distance or away from our business premises, you normally have a statutory right to cancel the contract within 14 days without giving a reason. The 14-day period normally begins on the day after the contract is formed.
This cancellation right may not apply to every contract or service, including where an applicable statutory exception applies. We will provide the information required by the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.
You may cancel by sending a clear statement to admin@marieairfixing.co.uk. You may use any wording that clearly tells us that you wish to cancel.
If you ask us expressly to begin the service during the 14-day cancellation period, you may still cancel during that period, but you must pay a proportionate amount for the work properly carried out up to the time you tell us that you have cancelled. If the service has been fully performed after your express request and acknowledgement that you would lose the cancellation right once the service was fully performed, the statutory cancellation right may end.
Where a consumer cancels lawfully, we will refund payments due under the applicable regulations using the required method and timescale, subject to any lawful deduction for services already supplied.
These statutory rights are in addition to any other rights you may have under the Consumer Rights Act 2015.
Installation work and workmanship
We will carry out the agreed services with reasonable care and skill, as required by the Consumer Rights Act 2015 where that Act applies.
You must tell us promptly if you believe that work is incomplete, defective or not carried out as agreed. We will investigate reported issues and, where we are responsible, will seek to put the work right within a reasonable time and without significant inconvenience.
We are not responsible for defects or damage caused by:
- Existing defects, unsuitable structures or systems;
- Incorrect information or instructions;
- Work carried out by someone else;
- Misuse, neglect, accidental damage or alteration;
- Failure to follow operating or maintenance instructions; or
- Conditions outside the agreed scope of work.
These points do not limit any statutory rights or remedies that cannot lawfully be excluded.
Equipment and manufacturer warranties
Where equipment is supplied, any manufacturer’s warranty or guarantee will be passed to you where applicable. The terms, duration and conditions of that warranty are set by the manufacturer, not by us.
We will provide reasonable assistance with a warranty claim where appropriate, but manufacturer warranties may require registration, maintenance or compliance with specified conditions. A manufacturer’s warranty does not affect your statutory rights against us.
Liability
Nothing in these terms excludes or limits liability for:
- Death or personal injury caused by negligence;
- Fraud or fraudulent misrepresentation;
- Breach of your statutory consumer rights;
- Any other liability that cannot legally be excluded or limited.
Subject to the above, we are responsible for losses that are a reasonably foreseeable result of our breach of these terms or our negligence. We are not responsible for loss caused by matters outside our reasonable control or by your failure to meet your responsibilities.
If you are a business, we will not be liable for indirect or consequential loss, loss of profit, loss of revenue, loss of business, loss of anticipated savings or loss of goodwill, to the extent permitted by law. Nothing in these terms limits a business customer’s obligation to pay for work properly provided.
